Latest topic for Spartanburg County Foundation’s popular Estate Planning educational series.

On March 14, 2024, the Spartanburg County Foundation welcomed Joshua Walden, Esq., Chief of Operations for the Center for Heirs’ Property as presenter for the latest in its Estate Planning series.

Mr. Walden reviewed the complexities of “family” land ownership, that which has been passed down through generations without the formality or legal protection provided by a will. The issue, prevalent in the South, provides unique challenges that put ownership at risk. Establishing a chain of title often involves a lengthy process digging through family records crossing multiple generations but is the first step in securing land for future generations. He reviewed facts and myths surrounding heirs’ property and provided cautionary examples around the risk of those using legal tactics around un-deeded property to force property sales.

Mr. Walden and the Foundation put together a guide to help participants consider their next steps in addressing their own family land security.
